Control constitucional y presidencialismo monárquico (1886-1910); demuestra que la consagración del control judicial de constitucionalidad en el Acto Legislativo 03 de 1910 no fue, de ninguna manera, una inferencia lógica del principio de supremacía de la Constitución; tampoco fue una solución a priori. Esta reforma fue una conquista de liberales y conservadores históricos, quienes buscaron responder a tres necesidades. La primera, contrarrestar el presidencialismo monárquico, la supremacía de la ley respecto de la Constitución y: la restricción a la libertad de prensa. La segunda romper la comprensión de las constituciones como arcas santas reformables sólo a balazos. Y la tercera, terminar con la práctica de usar las leyes fundamentales como instrumentos para oprimir y perseguir a los vencidos en la guerra.
