La presente obra se adentra en el fenómeno de la digitalización y aborda algunos de los principales desafíos a los que se enfrenta el Derecho ante la aparición de tecnologías disruptivas como la blockchain, la contratación inteligente o la inteligencia artificial. A través del estudio de la metodología comparada y de sus disciplinas conexas ofrece una visión general de los principales sistemas jurídicos que han influenciado a la mayoría de los ordenamientos de nuestro entorno, bien a nivel macrocomparado, bien con relación a instituciones jurídicas concretas. Los resultados constituyen la base desde la que plantea el análisis jurídico de las tecnologías digitales emergentes, entendiendo el Derecho comparado como una herramienta indispensable para entender la esencia del fenómeno jurídico y, por tanto, necesaria a la hora de pasar de una realidad continua, construida con relaciones jurídicas y normas, a otra discontinua, conformada por ceros y unos.
