Sinopsis
En este trabajo que el lector tiene por delante, su autor desarrolla una visión crítica de la regulación de la denuncia en España, en la que valora la eficacia de las últimas reformas en materia de protección de las personas denunciantes y traza perspectivas de futuro. Lo hace con una mirada permanentemente dividida entre el Derecho penal y el administrativo, en sus puntos en común y en sus divergencias, posibilitada y enriquecida, sin duda, por su formación y práctica como fiscal y magistrado. Aborda tanto la nueva normativa de protección del denunciante como el régimen "general" de la denuncia en el Derecho penal y administrativo -una regulación parca, contenida respecto del primero en unos pocos artículos de la Ley de Enjuiciamiento Criminal, por lo demás desactualizados, y de la Ley orgánica de protección a testigos y peritos en causas criminales, y, en relación con el segundo, en el artículo 62 de la Ley de Procedimiento Administrativo-. Y lo hace manejando fuentes no solo nacionales, sino también de Derecho europeo y comparado de países de nuestro entorno (Francia, Italia, Alemania, Portugal).
