La responsabilidad extendida del productor y los programas posconsumo en Colombia
Sinopsis
Desde el año 2007, Colombia ha proferido varias resoluciones en virtud de las cuales ha impuesto la obligación a los fabricantes e importadores (de plaguicidas, medicamentos, pilas y acumuladores, computadores e impresoras, baterías, llantas usadas y baterías usadas con plomo ácido), de diseñar,financiar e implementar programas de devolución selectiva de estos residuos. Esta obligación ha sido impuesta por el Gobierno Nacional a los fabricantes e importadores bajo el amparo del concepto de derecho internacional ambiental denominado Responsabilidad Extendida del Productor. Así mismo, se espera que en Colombia se implementen nuevos programas posconsumo regulados y voluntarios para productos como aparatos eléctricos y electrónicos, plásticos y aceites usados, entre otros. Este texto presenta un análisis comparado de las normas existentes; propuestas de ajustes regulatorios deconformidad con la aplicación de las resoluciones posconsumo en el día a día y la presentación de sugerencias regulatorias con base en el desarrollo actual en la literatura internacional.
