Esta "Teoría del derecho" se concibe como una concepción de la experiencia jurídica y, como tal, de la peculiar y personal respuesta de sus autores al cúmulo de temas, interrogantes y orientaciones que, convencionalmente, pueden incluirse bajo ese rótulo disciplinar. La obra pretende ser un interlocutor para los alumnos que inician los estudios de Derecho, a los que desea informar y orientar sobre el "status quaestionis" de los principales problemas teórico-jurídicos e incitarles a proseguir y profundizar en su estudio. Para ello se ha buscado la máxima claridad expositiva. En aras también de esos presupuestos pedagógicos se ha recurrido, a veces, a casos o ejemplificaciones.
Los autores de esta obra no comparten la actitud resignada que concibe la lucha por el derecho justo como un ideal quimérico sin sentido. Estiman, por el contrario, que la experiencia de la instrumentalización del derecho para el logro de objetivos inicuos no invalida, sino que estimula y apremia, el esfuerzo por vincular el derecho a aquellos valores que deben informar los sistemas normativos sociales para hacerlos dignos de los seres humanos.
